About the EB-5 Program

The EB-5 visa provides a method of obtaining a green card for foreign nationals who invest in a new commercial enterprise in the United States. The EB-5 program affords foreign nationals and their spouses and unmarried children under age 21 the ability to obtain a U.S. visa based solely upon a minimum investment in a for-profit enterprise that creates or retains a specified number of jobs.

The United States currently allots only 10,000 EB-5 Visa per year and those slots are distributed to various countries for an average of 700 slots per year per country. Also, if you are wanting visas for yourself and 4 family members under 21 and unmarried, you would require 5 visa slots. Several countries have a large backlog of EB-5 visa requests, such as China's backlog is 16 years.

To obtain the visa, individuals must invest a minimum of $1,050,000 (or a minimum of $800,000 if the investment is in a Targeted Employment Area) creating or preserving at least 10 jobs for U.S. workers excluding the investor and their immediate family. Targeted Employment Areas (TEA) are defined by local, State and Federal governmental agencies. Tangier Service Capital Group, Ltd, Inc. will assist our EB-5 investors in finding and determining if an investment is eligible for EB-5 and if it is TEA qualified.

If the foreign national investor's petition is approved by the United States Citizenship and Immigration Services (USCIS), the investor and their under 21 dependents will be granted conditional permanent residence valid for two years. Within the 90-day period before the conditional permanent residence expires, the investor must submit evidence documenting that the full required investment has been made and that 10 jobs have been maintained, or 10 jobs have been created or will be created within a reasonable time period. Tangier Service Capital Group, Ltd will work with our investors to provide this information to USCIS.

The current program was recently modified again by the EB-5 Reform and Integrity Act of 2022 so be certain whoever you use for an EB-5 investment is aware of the recent changes to the program.

EB-5 Green Card Timeframes

The EB-5 process is not a short term opportunity but could take a minimum of 56 months up to a maximum of 78 months. However, you will receive a Conditional Green Card within 18 - 22 months based on how busy USCIS is in handling Visa requests.

This process is still faster than the normal Green Card process which can take 10 years or more
